Solas Medical – Terms of Service

1. Product Description
This agreement pertains Solas Medical aesthetic devices, which are FDA-cleared and rigorously tested prior to sale. They are offered at a significantly reduced price compared to comparable U.S. models, which often range from $80,000 to over $100,000. Solas Medical LLC delivers quality, performance, and affordability.

2. Condition of Sale

  • All devices are sold as-is.
  • Devices are inspected and tested prior to shipping.
  • Any cosmetic imperfections that do not affect functionality are not grounds for return.

3. Warranty
This limited warranty is the sole and exclusive warranty provided by Solas Medical LLC. No other warranties, express or implied, apply.

  • Defective on Arrival (DOA) Guarantee: Ensures the machine and included parts are fully functional upon delivery. Issues must be reported within 7 calendar days of receipt, supported with video and/or photo documentation. If approved, Solas Medical LLC will coordinate the repair or replacement of the affected parts or device.
  • 2-Year Limited Warranty: Covers internal components, including the scanner, handpieces, and electronic systems, with free replacement parts provided for the first 6 months. After 6 months, the customer is responsible for the cost of replacement parts, though Solas Medical LLC will continue to provide remote support and sourcing assistance for the full 2-year period. Shipping costs are the responsibility of the customer.

Exclusions:
This warranty does not cover user error, misuse, improper operation, lack of maintenance, cosmetic damage, physical accidents (including drops or spills), or any unauthorized repairs or modifications. Parts broken due to misuse or accidental damage may be replaced at the customer's cost.

Warranty Claims:
All claims and service inquiries must be submitted directly to solasmedllc@gmail.com. Solas Medical LLC is the sole point of contact for support related to this device.

4. Support & Training
Customers will receive support via email and direct messaging for troubleshooting and guidance. As the company scales, support may shift to email-only. A comprehensive video training library is hosted on the Solas website, covering setup, treatment protocols, maintenance, and troubleshooting.

5. Returns & Refunds
a. Defective on Arrival (DOA):

  • Report within 7 calendar days of delivery.
  • Provide video and photo documentation (full unboxing video recommended).
  • If defect is confirmed, a prepaid return label will be issued.
  • If defect cannot be confirmed remotely, customer must return at their own expense. Upon inspection, if defect is verified, return shipping will be reimbursed and a replacement provided.

b. Customer-Initiated Returns (No Defect):

  • All sales are final; returns of functional devices may be accepted at Solas Medical LLC’s discretion.
  • Request within 7 calendar days of delivery.
  • Device must be unused, in original condition, and include all accessories and packaging.
  • Customer covers return shipping and insurance costs.
  • A restocking fee of up to 20% may apply.
  • No refunds for used, damaged, or incomplete units.

This return policy does not affect the DOA guarantee or warranty coverage described in Section 3.

6. Payment Terms
Payment can be made via ACH transfer (no fee), direct payment through the Solas Medical LLC Shopify website, or through Shop Pay and other supported methods. PayPal and Venmo payments incur a 3.5% processing fee. Devices ship only after full payment is received and cleared.

7. Shipping
Standard shipping is included within the continental U.S. (4–6 weeks). Additional shipping fees apply for remote, non-continental U.S., or international locations.

8. Liability & Disclaimer
Solas Medical LLC is not liable for adverse outcomes, injuries, property damage, or legal actions resulting from use, misuse, modification, or improper operation.
It is the customer’s responsibility to ensure they are properly licensed, certified, and operating the device within applicable laws.

Disclaimer of Warranties:
Except for the express warranties stated, Solas Medical LLC disclaims all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Indemnification:
The customer agrees to indemnify and hold harmless Solas Medical LLC, its owners, officers, and affiliates from any claims, liabilities, damages, or expenses arising from use of the device.

9. Acknowledgment
By signing or submitting payment, the customer agrees to these terms, including warranty limitations, training disclaimers, return policy, and liability waivers. A signed copy is not required for these terms to be binding.

10. Training Disclaimer
Any training materials, demonstrations, videos, or advice provided by Solas Medical LLC are for informational purposes only.
It is the buyer’s sole responsibility to ensure they are trained, licensed, and qualified to operate the device in accordance with all laws.
Solas Medical LLC assumes no liability for injuries, outcomes, or damages resulting from misuse or misinterpretation of training content.

11. Intellectual Property Rights
All training videos, manuals, documents, and materials are the exclusive intellectual property of Solas Medical LLC.
They may not be copied, reproduced, distributed, licensed, resold, or used for commercial purposes without written consent.

 

Solas Medical Full Warranty Policy

At Solas Medical, we understand the challenges that come with selecting and investing in new medical and aesthetic equipment. Our machines are top-quality, offering superior performance and reliability for clinical use.

To protect your investment, Solas Medical proudly offers a 2-year warranty as well as a 7-day shipping damage protection guarantee. Please read the details carefully.

Overview of Our Guarantees

Each Solas Medical device is covered by a 2-year warranty (the “Warranty”) starting from the date of delivery.

Every device is also covered by a 7-day shipping damage protection guarantee (the “Damage Protection Guarantee”) to protect you against shipping damage.

General Exceptions

Consumable items (such as gels, liquids, cartridges, or tips) are not covered under the Warranty.
Handheld devices are also not covered by the Warranty but are covered by the 7-day Damage Protection Guarantee.
Devices sold for less than $1,000 are covered by the Warranty for 6 months only.

Unboxing Video Requirement

To apply the Damage Protection Guarantee, you must record an unboxing video while initially unpacking your equipment. This is essential to ensure your satisfaction and verify claims.

Unboxing Guidelines:

  • Inspect and video the package when delivered.
  • Place the camera on a stable surface in a well-lit area.
  • Clearly show the shipping label (with tracking number, your address, and product details).
  • Show all sides of the package to confirm it’s unopened.
  • Record the entire unpacking process, including lifting the machine out of the box.
  • Check for damage or wrong items immediately on video.
  • Do not take the product out of frame or stop recording.

We will not honor claims without a continuous, clear unboxing video.

Damage Protection Guarantee Terms

  1. If all the following apply:
    The machine or included parts arrive non-functional, broken, or as the wrong product (significantly different from description).
  2. Damage is more than minor cosmetic issues or box scuffs.
  3. You report the damage in writing to solasmedllc@gmail.com within 7 calendar days of delivery.
  4. You provide a clear unboxing video showing the entire unpacking process.
  5. You participate in a brief video call with Solas Medical technical support if requested.
  6. Our technical team verifies the damage was not caused by unpacking and affects function.
  7. None of the listed Exceptions to the Damage Protection Guarantee apply.

Then, Solas Medical will provide a free return shipping label (for U.S. customers) and send you a replacement part or replacement device (whichever is appropriate) at no cost.

Exceptions to the Damage Protection Guarantee

We do not cover:

  • Damage from unpacking mishandling (scrapes, friction marks).
  • Misuse, liquid mishandling, or dropping.
  • Cosmetic blemishes not affecting function.
  • Damages reported without required evidence (video/photos).
  • Claims made after 7 days.
  • Box-only damage.
  • Customer dissatisfaction with results (vs. device defects).

Warranty Terms

The Warranty applies only to purchases made directly from solasmedllc.com. It is non-transferable unless approved by our legal team in writing.

✅ Covers:

  • Remote tech support via Zoom/FaceTime.
  • Video instructions to assist with part replacements.
  • Free necessary replacement parts within the first 6 months.

❌ Does not cover:

  • Normal wear and tear, tips, or accessories.
  • Inappropriate use or accidental damage.
  • Revenue loss from downtime.
  • Shipping costs (customer’s responsibility after 6 months).
  • Warranty time resets — it stays fixed from original delivery.

Exceptions That Void the Warranty

  • Failure to provide requested evidence (videos, photos).
  • Ignoring instructions or misuse.
  • Refusing to participate in troubleshooting calls.
  • Altering the device or applying foreign substances.
  • Opening a chargeback or payment dispute.

Support After the Warranty

Solas Medical remains available for support after the warranty period, though costs may apply depending on your needs. Replacement parts will continue to be available.
